What the free consultation actually is

The diagnosis is free. That is the point.

Most people who call are not sure whether they even need probate, which kind, or what it should cost. That uncertainty is exactly what the consultation clears up. We tell you which path fits, quote a flat fee for uncontested work, and point you to the next step, at no charge and with no obligation to hire us.

To be straight with you: the consultation is free. The legal work is not, and we will never pretend otherwise. What you get for free is a clear, experienced read on your situation, so you are making decisions with real information instead of guessing.

"You should not have to hire a lawyer just to find out what you are dealing with. Tell me what happened, and I will tell you which probate you need and what it costs. If you do not need me, I will tell you that too."

What happens in your free consultation

Because probate is nearly all we do, and because we work through Tarrant County's statutory probate courts, we can usually diagnose your situation and quote it on the first call. Here is how it goes.

1

You tell us what happened

By phone or video, on your schedule. There is nothing to fill out first and no fee to talk. You explain who passed, whether there was a will, and what the estate includes. Most first calls take about twenty minutes.

2

We tell you which probate you actually need

Tarrant County estates do not all run the same path. We tell you whether you need a full independent administration, a lighter muniment of title, an affidavit of heirship or small estate affidavit, or possibly no probate at all. That answer alone is worth the call.

3

You get a straight answer on cost

For uncontested matters we quote a flat fee, confirmed before any work begins, so you know the full number up front. If your situation is contested, we tell you it is billed hourly and roughly what that means, before you commit to anything.

4

No pressure to hire us

You leave the consultation knowing your options and your likely cost whether or not you hire us. There is no obligation, and if the estate turns out to be simple enough that it may not need formal probate at all, we will tell you that too.

5

Information gathering, not a do-it-yourself guide

The consultation is the information-gathering stage: you learn what you are dealing with, which path the estate needs, and what it costs. What it is not is a blueprint for filing on your own. In Texas an executor acts on behalf of the estate's heirs and creditors, so filing probate without an attorney is treated as the unauthorized practice of law, and the only real exception is a sole beneficiary with a simple estate. Even then it rarely pays to go it alone, because the executor is personally liable and one missed deadline or filing error can delay probate for months and cost far more than it saved. For almost everyone, the real question the call answers is not whether to use an attorney, but which one, and probate is all we do, not an occasional add-on to family, divorce, or injury law.

What to have ready

You do not need to prepare anything to call, but the consultation is faster and more useful if you can speak to a few things. None of these are dealbreakers, and part of our job is telling you what is missing.

  • Roughly when the person passed away, and a death certificate if you have one.
  • Whether there is a will, and where the original signed copy is kept.
  • A rough list of the major assets: the house, bank and investment accounts, vehicles, any business interest.
  • Whether any asset is in the deceased person's name alone, versus jointly owned or with a named beneficiary.
  • The property address if the estate includes real estate in Tarrant County.
  • Whether the heirs agree, or a dispute may be brewing.

Free to talk, flat fee to finish

Once you know which path the estate needs, the cost stops being a mystery. Most uncontested Tarrant County matters are handled on a transparent flat fee you agree to before any work begins, and most of the process runs almost entirely online. The free consultation is simply the first step: a straight answer, at no cost, so you can decide what to do next with real information.

Many do, and we do. Our first consultation is always free and comes with no obligation. Yes, the consultation itself is always free. What changes is the work that follows. Uncontested probate is handled on a flat fee, while contested matters like will contests and estate litigation are billed hourly, because the length of a dispute cannot be predicted up front.
